بخدمت جناب صدر ذیشان احسن بٹ صاحب ڈی ایچ اے اسٹیٹ ایجنٹس ایسوسی ایشن لاہور موضوع: متنازعہ آئینی ترامیم — الیکشن میں حصہ لینے والے ممبران کے لیے تعلیمی اہلیت کی شرط اور ووٹ ڈالنے کے حق کو ڈی ایچ اے رینیول فیس کی ادائیگی سے مشروط کرنے کے خلاف درخواست جنابِ عالی! نہایت ادب و احترام کے ساتھ گزارش ہے کہ گزشتہ AGM میں پیش کی جانے والی بعض قراردادوں اور آئینی ترامیم کے حوالے سے کمیونٹی کے اندر سنجیدہ تحفظات پائے جاتے ہیں۔ ان میں بالخصوص الیکشن میں حصہ لینے والے ممبران کے لیے تعلیمی اہلیت کی شرط عائد کرنا اور ووٹ ڈالنے کے حق کو ڈی ایچ اے رینیول فیس کی ادائیگی سے مشروط کرنا قابلِ غور معاملات ہیں۔ 1۔ ایجنڈے کی بروقت فراہمی اور کورم کا معاملہ گزشتہ AGM میں پیش کی جانے والی قراردادوں اور مجوزہ ترامیم کے بارے میں کمیونٹی کو پیشگی آگاہ نہیں کیا گیا اور نہ ہی اجلاس کا ایجنڈا ممبران تک بروقت پہنچایا گیا۔ اجلاس کے دوران جنرل سیکریٹری صاحب نے بھی اس امر کا اعتراف کرتے ہوئے معذرت کی، جس کی ویڈیو ریکارڈنگ بھی موجود ہے۔ ایسی صورتِ حال میں یہ سوال پیدا ہوتا ہے کہ جب ایجنڈے کی عدم فراہمی کا اعتراف موجود ہے اور اجلاس کے کورم کی تکمیل پر بھی سوالات اٹھائے جا رہے ہیں، تو ان ترامیم کی منظوری کس طریقۂ کار کے تحت حاصل کی گئی؟ مزید یہ کہ اگر ترامیم کی منظوری کے لیے مطلوبہ کورم پورا نہیں تھا، تو ان کی منظوری اور سب رجسٹرار کے دفتر میں ان کی رجسٹریشن کے قانونی و آئینی جواز کی وضاحت ضروری ہے۔ اس معاملے کی مکمل چھان بین کی جانی چاہیے تاکہ ممبران کے تحفظات دور ہو سکیں۔ 2۔ الیکشن میں حصہ لینے کے لیے تعلیمی اہلیت کی شرط کسی بھی ممبر کے لیے الیکشن لڑنے کی خاطر تعلیمی اہلیت کی نئی شرط عائد کرنا ایک اہم معاملہ ہے، جس کے اثرات ممبران کے بنیادی حقوق پر مرتب ہو سکتے ہیں۔ جب کوئی شخص ایسوسی ایشن کے مقررہ قواعد و ضوابط کے مطابق ممبرشپ حاصل کر لیتا ہے، تو اس کے انتخابی حقوق پر پابندی عائد کرنے کے لیے واضح جواز ہونا چاہیے۔ محض ایک نئی شرط عائد کرکے کسی موجودہ ممبر کو الیکشن میں حصہ لینے کے حق سے محروم کرنا، اس کے بنیادی اور جمہوری حقوق کے منافی ہو سکتا ہے۔ لہٰذا اس شق کا غیر جانب دارانہ جائزہ لیا جائے اور اس بات کو یقینی بنایا جائے کہ کسی بھی ممبر کے ساتھ غیر منصفانہ سلوک نہ ہو۔ 3۔ ووٹ ڈالنے کے حق کو ڈی ایچ اے رینیول فیس سے مشروط کرنا ایسوسی ایشن کی ممبرشپ اور ووٹ ڈالنے کے حق سے متعلق شرائط پچھلے 25سالوں سے واضح، ہیں کہ ایسویسی ایشن کی ممبر بننے کے بعد وہ ووٹ ڈالنے کا حقدار ہے یہ معاملہ محض انتظامی نوعیت کا نہیں بلکہ ممبران کی نمائندگی، جمہوری شرکت اور انتخابی حقوق سے براہِ راست تعلق رکھتا ہے۔ اس لیے اس حوالے سے کسی بھی پابندی کا نفاذ متعلقہ آئین، قواعد و ضوابط اور قابلِ اطلاق قانون کی روشنی میں ہونا چاہیے۔ 4۔ ممبران کے بنیادی حقوق کا تحفظ ایسوسی ایشن کا بنیادی مقصد ممبران کے حقوق کا تحفظ، ان کی نمائندگی اور جمہوری اصولوں کے مطابق اجتماعی معاملات چلانا ہے۔ کسی بھی آئینی ترمیم کی منظوری میں شفافیت، مناسب نوٹس، مطلوبہ کورم اور ممبران کی آزادانہ رائے کو بنیادی اہمیت دی جانی چاہیے۔ استدعا مندرجہ بالا حقائق اور تحفظات کی روشنی میں جنابِ صدر سے مؤدبانہ گزارش ہے کہ: 1. متنازعہ آئینی ترامیم کی منظوری کے طریقۂ کار، اجلاس کے ایجنڈے کی فراہمی، کورم اور سب رجسٹرار کے دفتر میں ان کی رجسٹریشن کا مکمل جائزہ لیا جائے۔ 2. الیکشن میں حصہ لینے کے لیے تعلیمی اہلیت کی شرط اور ووٹ ڈالنے کے حق کو ڈی ایچ اے رینیول فیس کی ادائیگی سے مشروط کرنے والی شقوں کادوبارہ سے جائزہ لیا جائے۔ 3. اس معاملے کو ایسوسی ایشن کی سپریم باڈی، یعنی ممبران کے مجاز فورم کے سامنے باقاعدہ AGM 24-Oct-2026 ایجنڈے کے طور پر پیش کیا جائے۔ 4. سپریم باڈی کے ممبران کو ان شقوں کے حق اور مخالفت میں اپنی آزادانہ رائے دینے کا مکمل موقع فراہم کیا جائے اور متعلقہ آئین و قواعد کے مطابق باقاعدہ ووٹنگ کرائی جائے۔ 5. جائزے اور ووٹنگ کے نتائج کی روشنی میں ایسا فیصلہ کیا جائے جو ایسوسی ایشن کے مفاد، ممبران کے حقوق اور جمہوری اصولوں کے مطابق ہو۔ امید ہے کہ آپ اس اہم معاملے کو ذاتی یا گروہی اختلاف کے بجائے ممبران کے اجتماعی مفاد اور اس پلیٹ فارم کی مضبوطی کے تناظر میں دیکھتے ہوئے منصفانہ فیصلہ فرمائیں گے۔ ممبران کے حقوق کا تحفظ، شفافیت اور جمہوری اقدار ہی ایک مضبوط اور باوقار ایسوسی ایشن کی بنیاد ہیں۔ والسلام رفاقت علی کیانی چیئرمین M&B CEO، Metro Estate & Builders (Reg) 221-Y، DHA لاہور

To: Mr. Zeeshan Ahsan Butt President, DHA Estate Agents Association, Lahore Subject: Objection to Controversial Amendments Regarding Educational Qualifications for Contesting Elections and Making Voting Rights Conditional upon Payment of DHA Renewal Fees Respected Mr. President, With due respect, I wish to draw your attention to certain controversial resolutions and constitutional amendments presented during the previous Annual General Meeting (AGM), which have raised serious concerns within the community. In particular, these concerns relate to the introduction of an educational qualification requirement for members wishing to contest elections and the imposition of a condition linking the right to vote with the payment of DHA renewal fees. 1. Non-Communication of the Agenda and Questions Regarding the Quorum The resolutions and proposed amendments presented during the previous AGM were neither communicated to the community in advance nor was the agenda circulated to the members in a timely manner. During the AGM, the General Secretary acknowledged this failure and also tendered an apology. A video recording of this acknowledgment is available as evidence. In these circumstances, serious questions arise regarding the validity of the decisions taken during the meeting. If the General Secretary acknowledged that the agenda had not been circulated and concerns also existed regarding the completion of the required quorum, it is essential to clarify the procedure under which these amendments were approved. Furthermore, if the mandatory quorum was not present, the legal and constitutional validity of the amendments, including their subsequent approval or registration with the Registrar, requires proper scrutiny. The entire process should be examined transparently to address the legitimate concerns of the members. 2. Educational Qualification as a Requirement for Contesting Elections Imposing a new educational qualification requirement on members wishing to contest elections is a significant matter that may affect their electoral and democratic rights. Once an individual has acquired membership in accordance with the prescribed rules and regulations of the Association, any restriction on that member's right to contest elections must have a clear constitutional and legal basis. Disqualifying an existing member from contesting elections merely by introducing a new condition, without proper legal and constitutional authority, may amount to an unjustified restriction on that member's fundamental and democratic rights. Therefore, this provision should be reviewed impartially to ensure that no member is subjected to unfair or discriminatory treatment. 3. Making the Right to Vote Conditional upon Payment of DHA Renewal Fees The conditions governing membership and voting rights must be clear, transparent, and applied equally to all members. If a member continues to hold valid membership of the Association under its applicable rules, the legal and constitutional basis for making that member's right to vote conditional upon payment of DHA renewal fees must be clearly established. This is not merely an administrative matter; it directly concerns the democratic participation, representation, and electoral rights of the members. Accordingly, any restriction of this nature must be examined in light of the Association's registered constitution, applicable rules and regulations, and relevant law. 4. Protection of Members' Rights and Democratic Principles The primary purpose of an Association is to protect the interests of its members, represent their concerns, and conduct its affairs in accordance with democratic principles. Once an individual has fulfilled the prescribed requirements for membership, any restriction on that member's electoral rights must be supported by a valid legal and constitutional basis and introduced through the proper procedure.
